Welcome to GammaGlow Marketing Systems LLC ("GammaGlow", "we", "us", or "our"). By purchasing, accessing, or using our software, AI agents, website systems, and related services (collectively, the "Services"), you ("Client", "User", or "Business") agree to be bound by these Terms of Service.

1. Description of Services

GammaGlow provides automated business solutions, including but not limited to AI-driven chat agents, website development, automated appointment booking, database reactivation, and reputation management. Our Services act as a technology platform to facilitate your business operations.

2. Telecommunications & TCPA Compliance (Client Liability)

GammaGlow provides tools that allow you to communicate with your customers via SMS, text message, and voice calls (e.g., "Missed-Call Text-Back" and "Database Reactivation").

  • Consent is Your Responsibility: You, the Client, are solely and strictly responsible for ensuring that you have obtained the legally required explicit, written consent (opt-in) from every individual before sending them automated text messages or marketing communications.

  • TCPA Indemnification: You agree to fully comply with the Telephone Consumer Protection Act (TCPA) and all other applicable federal, state, and local telecommunications laws. You agree to indemnify, defend, and hold harmless GammaGlow from any claims, lawsuits, fines, or damages arising from your failure to obtain proper consent or your misuse of our messaging tools.

3. Third-Party Accounts and "Bring Your Own Key" (BYOK)

Certain features of the Services require the use of third-party platforms (e.g., Twilio for telecom, Stripe for payments, Google/Meta for ads and reviews).

  • You are responsible for creating, maintaining, and paying for your own third-party accounts where applicable.

  • GammaGlow is not responsible for any account suspensions, billing errors, or service interruptions caused by these third-party providers.

4. Artificial Intelligence (AI) Disclaimer

GammaGlow utilizes advanced Artificial Intelligence (including AI Voice and Web Chat Agents) to interact with your customers.

  • Experimental Technology: You acknowledge that AI technology is experimental and can occasionally produce unpredictable or inaccurate responses ("hallucinations").

  • No Liability for AI Output: GammaGlow shall not be held financially or legally liable for any loss of business, incorrect pricing quoted, incorrect business hours provided, or any other errors made by the AI agent during interactions with your customers. You are encouraged to monitor your AI agent's conversations through your dashboard.

5. Billing and Subscription

  • Payments: Services are billed on a recurring monthly subscription basis according to the tier selected (e.g., The Prospect Engine, Accelerator, Market Leader).

  • No Refunds: Due to the custom setup and hard costs associated with provisioning AI systems and software infrastructure, all payments are non-refundable. You may cancel your subscription at any time to prevent future billing.

6. Limitation of Liability

To the maximum extent permitted by law, GammaGlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services. In no event shall GammaGlow's total liability exceed the amount you paid to us in the one (1) month preceding the event giving rise to the claim.

Privacy Policy Snapshot

Data Collection: We collect business information, digital assets (logos, images), and third-party API keys provided by you to build and run your system. We do not sell your data or your customers' data to outside data brokers. Customer Data: The leads, phone numbers, and customer profiles generated by your GammaGlow system belong exclusively to you. We only process this data to facilitate your AI automation and text messaging features. We employ industry-standard security measures to protect your database.
